Adidas has lost in its bid to expand the protection surrounding its Three Stripes trademark.

The battle against BVBA brand which has two oblique bands on its sneakers has been going on since 2014. But the European Court ruled that the Adidas design was not “distinctive” enough, which means that the three bands are not protected anymore!

Past Wednesday, the European Union General Court ruled against Adidas’s claim that its famous three stripes deserve trademark protection. This verdict had a significant impact on the sportswear brand, which will no longer be allowed to sue other companies for copying their logo.

The Court stated that the German company could not prove that the tapes were sufficiently distinctive.

“The mark is not a pattern mark composed of a series of regularly repetitive elements, but an ordinary figurative mark” – The Court
